The verdict was delivered by Resident Magistrate John Msafiri who said the prosecution side, through their witnesses and exhibits brought before the court, was able to prove beyond reasonable doubt that Yasin, a resident of Kongowe Kibaha in Coast Region, committed the offence.
The court also set free Omari Kilos (28), a resident of Keko and Joram Charles (24) from Yombo, after the prosecution failed to prove without reasonable doubt that they committed the offence.
The accused were charged with armed robbery and after being found with a case to answer they embarked on proving their innocence, but Yasin was found guilty.
Before reading the verdict, Magistrate Kisoka asked the prosecution led by State Attorneys Neema Mushi and Erick Shija asked the court to hand severe punishment as required by the law to send a message to the society that offences of armed robbery were unacceptable.
Reading the verdict, magistrate Msafiri said he had gone through the evidence tendered in court by the prosecution through their four witnesses and other evidence, saying they were able to prove beyond reasonable doubt that only Yasin committed the offence.
Before reading the judgment, magistrate Msafiri asked the accused if he had anything to say whereby he insisted to the court that he did not commit such an offence and he knew nothing about it. Magistrate Msafiri said the accused will serve 30 years in jail.
According to the charge sheet, on April 17, 2014 at Barack Obama road within Ilala District, the accused stole a Nokia phone, a Star times decoder, four bank cards, one lap top, two flash disks and cash 14,000/-.
It was alleged that all the items, the property of Ezekiel Saul, were valued at more than 2m/-.
It was further alleged that immediately before such theft the accused threatened Saul with bush knives in order to obtain the aforesaid properties.
